MINI Purchase Cancellation Policy – Distance Sales
For consumers in the UK not using finance to purchase a new or young used MINI from BMW (UK) Limited.
1. About this policy
1.1. We are BMW (UK) Limited, a company registered in England and Wales with company registration number 01378137. We use trading styles that include MINI and MINI UK. Our registered office is at Summit One, Summit Avenue, Farnborough, Hampshire, GU14 0FB.
1.2. In this policy:
1.2.1. ‘we’, ‘us’ or ‘our’ means BMW (UK) Limited,
1.2.2. ‘you’ or ‘your’ means the person ordering the vehicle, who will be named on the Order Confirmation,
1.2.3. our ‘Retailers’ means our authorised MINI agents in the UK,
1.2.4. ‘Terms of Sale’ means the terms and conditions subject to which we sold to you, and you purchased a vehicle. These can be found in your MINI online account; and
1.2.5. ‘vehicle’ means the vehicle and any accessories and services supplied by us as detailed on the Order Confirmation.
1.3. This policy sets out the amount we may deduct from your refund if you return your vehicle under your distance cancellation rights, explained in section 9(1) of the Terms of Sale.
1.4. If you entered into a finance agreement for the purchase of your vehicle, you should refer to your finance agreement for any rights to cancel or withdraw from your finance agreement. You can discuss this with your finance provider or the Retailer who arranged your finance, not us.
1.5. To exercise your distance cancellation rights, you must follow the instructions set out in Section 9(1) of the Terms of Sale.
1.6. This policy does not apply if you are returning a vehicle to us because of a problem with it; this is explained in Section 10 of the Terms of Sale.
2. Cancellation refund deductions
2.1. If you exercise your distance cancellation rights after you have taken delivery of the vehicle, you must return the vehicle to us at the Retailer from which you collected it, at your own expense, within 14 days of notifying us of the cancellation.
2.2. We will not make any refund until the vehicle has been returned to our Retailer.
2.3. Within 14 days of the vehicle being returned to our Retailer we will refund to the bank account from which you paid for the vehicle the full amount that you paid for the vehicle less those amount we are allowed deduct. These amounts are explained below.
2.4 Excess Mileage: You may drive the vehicle up to 100 miles to establish the nature, characteristics and functioning of it. If you have driven the vehicle more than this, we will deduct:
2.4.1. for a MINI Cooper and Aceman (all variants) - 40 pence per mile for each mile driven in excess of 100 miles; and
2.4.2. for a MINI Countryman - 50 pence per mile for each mile driven in excess of 100 miles.
2.5. Damage charges: If the vehicle has any damage that was not present when you took delivery of it, we will deduct the cost of repairing the damage and any loss in value. This cost will be calculated and notified to you.
2.6. Vehicle documents & keys: You must return all manuals, service records and keys supplied with the vehicle, including the relevant part of the vehicle registration document. This is to enable us to transfer ownership of the vehicle back to us. If you do not return any of these items, we may deduct the cost of replacing them from your refund. This cost will be notified to you. You are responsible for cancelling the vehicle tax and obtaining any refund due from the relevant authority.
2.7. Other changes to the vehicle: If you have altered or personalised the vehicle in any way, you must restore it to the condition it was in when you took delivery before returning it. If you do not, we will deduct the cost of returning the vehicle to the condition it was in when you took delivery of it and of any loss in value. However, if at the time you purchased the vehicle, you also purchased certain MINI Approved Parts from one of our Retailers which have been affixed to the vehicle, we may accept the returned vehicle with those parts attached. Please contact our Retailer or us to discuss this before returning your vehicle.
2.8. Digital Services: If you have purchased any Digital Services for your vehicle, these will be cancelled when you return it. You may be charged for any use you have made of these services before returning the vehicle and we may deduct this from your refund.
3. Part exchanges
3.4. Part exchanges: If our Retailer purchased a part-exchange vehicle from you, and the value was put towards your new MINI vehicle, we will include that amount in your refund (subject to the deductions explained in section 2). Neither we nor our Retailer will be able to arrange the return of your part-exchange.
4. Complaints
4.1. Complaints: If you are unhappy with the way your cancellation or return has been dealt with, please direct any complaints to our Retailer or us on customer.information@mini.co.uk or 0370 50 50 175. You can find our complaints procedure on the MINI website. If we or they are unable to resolve your complaint to your satisfaction you can refer your complaint to the Motor Ombudsman, who can be reached using the following details:
